1. Acceptance of Terms

By requesting a quote, engaging our services, or using this website (simplystoneandmarble.com), you agree to these Terms of Service. If you do not agree, please do not use our services or this site.

2. Services

Simply Stone and Marble, Inc. (“Simply Stone and Marble,” “we,” “us”) provides consulting, estimating, project oversight, procurement, fabrication, and installation of granite, marble, quartz, tile, and large-format porcelain panel surfaces for commercial and residential projects throughout California, Nevada, and Arizona.

3. Pricing

Because every project involves different materials, dimensions, and site conditions, we do not use a fixed price list. All pricing is provided through a custom, project-specific quote after consultation and, where needed, an on-site evaluation. Quoted prices are in U.S. dollars.

4. Quotes and Estimates

All quotes and estimates are based on the project information available at the time and are valid for 30 days unless otherwise stated. Final pricing may be adjusted for site conditions discovered after an on-site evaluation, material availability, or changes requested after work begins. Quotes are not binding until confirmed in writing and accompanied by any required deposit.

5. Payment Terms

  • Deposits. Custom fabrication work generally requires a deposit of 50% of the project total before materials are ordered or fabrication begins, unless a different amount is agreed to in writing.
  • Invoicing. Invoices are issued electronically through our payment processor, Stripe. Final payment is due upon completion of installation unless other terms are agreed to in writing.
  • Late payment. Invoices not paid within the stated due date may be subject to a late fee and/or suspension of further work until the account is brought current.
  • Accepted payment methods. We accept payment by credit card, debit card, and bank transfer (ACH) through Stripe. We do not store your card or bank account details — Stripe processes and secures all payment information. See our Privacy Policy for details.

6. Returns, Refunds, and Cancellations

Returns, refunds, and cancellation terms are detailed in our separate Returns, Refunds & Cancellation Policy, which forms part of these Terms.

7. Scheduling and Site Access

Client is responsible for providing reasonable access to the project site during scheduled work hours and for ensuring the site is ready for work as agreed (e.g., prior demolition, utilities, or clearances completed). Delays caused by lack of site access or readiness may result in rescheduling and additional charges.

8. Change Orders

Any changes to the agreed scope of work — additional materials, design changes, or added square footage — must be agreed to in writing and may result in adjusted pricing and timeline.

9. Warranty

We warrant our fabrication and installation workmanship to be free of defects for a period of one (1) year from the date of completion. This warranty covers workmanship only and does not cover: normal wear and tear, damage from improper use or maintenance, damage from third parties, or natural characteristics of stone and tile (such as veining, color variation, or minor fissures) that are inherent to the material. Manufacturer warranties on materials (where applicable) are passed through to the client.

10. Promotions

We do not currently run promotional offers or discounts. If we do in the future, the specific terms and conditions of that promotion will be posted alongside it and will govern in the event of any conflict with these Terms.

11. Legal and Export Restrictions

Not applicable. We provide fabrication and installation services only within the United States, specifically California, Nevada, and Arizona, and do not ship or export materials internationally.

12. Limitation of Liability

To the fullest extent permitted by law, Simply Stone and Marble, Inc.’s total liability for any claim arising from our services is limited to the amount paid for the specific project giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

13. Force Majeure

We are not responsible for delays or failure to perform due to causes beyond our reasonable control, including material shortages, extreme weather, labor shortages, or other events of force majeure.

14. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or our services that is not resolved directly between the parties will be subject to the exclusive jurisdiction of the state and federal courts located in Orange County, California, and each party consents to venue there.
